Abstract

This research evaluates the legal standing of unilateral dismissals executed by foreign diplomatic missions against local employees under Indonesian statutes. The primary legal tension lies between the mandate of national labor protection and the principle of diplomatic immunity. Utilizing a normative legal method with a case-based approach, this study aims to clarify dispute resolution mechanisms and judicial reasoning. The results demonstrate that employment contracts with local staff constitute private legal acts (acta jure gestionis), thereby falling under national jurisdiction. Consequently, arbitrary termination without adherence to legal procedures is deemed unlawful. This study asserts that diplomatic immunity is not an absolute shield in private labor matters, emphasizing the necessity of legal safeguards for workers and enhancing legal certainty regarding foreign entities' obligations.
